Pring-Mill's study depicts the prevalent, but often neglected worldview of the Middle Ages, according to which the macrocosm is a chain of created being ascending from the four elements of the material world to the numerologically structured celestial spheres up to the creator himself. Pring-Mill's work reveals a fundamental correspondence between the three major religions: medieval Christians, Jews and Muslims all sought to describe their religious beliefs using the structures of the macrocosm. Ramon Lull's (1232-1316) philosophy makes use (...) of this idea in order to render Christian doctrine intelligible. In his dynamic conception, man is depicted as a microcosm, thus becoming the archetype of the macrocosm and, at the same time, the image of divine trinity. Pring-Mill's study, therefore, is not only a guide to Llull's complete oeuvre, but also an introduction to medieval thinking in general. Auch die Philosophie Ramon Llulls (1232-1316) bedient sich dieser Vorstellung, um die christliche Lehre verstandlich zu machen. Der Mensch wird in einer dynamischen Auffassung als Mikrokosmos beschrieben. Dadurch wird er zum Urbild des Makrokosmos und zum Abbild der gottlichen Dreifaltigkeit. PORTUGUESE: Neste artigo, apresentaremos uma visão particular do desenvolvimento de teorias científicas que denominamos (inspirados em Ortega y Gasset) "perspectivismo". Discutiremos como, através desse enfoque, é possível compatibilizar diversas descrições aparentemente distintas e incompatíveis de uma suposta realidade que se investiga. Fazemos isso distinguindo entre a "realidade" (R) e a "descrição empírica da realidade" (Re). Aceitando que podemos ter diversas descrições empíricas de uma mesma realidade, discutimos o caso particular em que esse esquema é utilizado nos debates atuais acerca da (...) ontologia da física quântica, em especial da mecânica quântica não relativista. Como se sabe, essa teoria é compatível com distintas ontologias (ou metafísicas), em particular, pode ser vista como comprometida com uma ontologia de indivíduos, mas também com uma ontologia de não indivíduos. Ambas as alternativas são plausíveis e merecem ser desenvolvidas. Propomos que o perspectivismo aqui apresentado é neutro com relação à escolha de uma metafísica (ontologia), bem como aos debates entre realistas e antirrealistas em filosofia da ciência. Concluímos que passar do pluralismo aceito pelo perspectivista ao realismo ou antirrealismo envolve comprometimento com teses mais robustas acerca da relação entre realidade e descrição da realidade. ENGLISH: In this article we present a particular view of the development of scientific theories which (following Ortega y Gasset), we term "perspectivism". Making use of this view, we discuss how we can accommodate distinct and apparently incompatible descriptions of a supposed reality under investigation. We distinguish between a "reality" (R) and its "empirical description", (Re). Acknowledging that we can have diverse empirical descriptions of the same reality, we discuss the particular case in which the view is applied to current debates on the ontology of quantum physics, especially of non-relativistic quantum mechanics. As it is well known, this theory is compatible with treating quantum objects either as individuals or as non-individuals. Both ontologies are possible and deserve to be developed. We propose that the perspectivism developed here is neutral not only with respect to the choice of an ontology, but also concerning the debates among realists and anti-realists in the philosophy of science. We conclude that to go beyond the pluralism accepted by perspectivism, and to adopt realism or anti-realism, involves commitment to strong theses about the relation between reality and its descriptions. One possible avenue of enquiry which he identified as conspicuously absent in this respect was the development of a distinctively Catholic approach to problems of educational philosophy, observing that a work of the mid-war years, Maritain's Education at the Crossroads, appeared to be well (...) nigh the only modern effort in this direction. More than a decade on from this, in a climate no longer exclusively dominated by conceptual analysis - indeed, in which there is unprecedented interest in a wealth of different schools, traditions and approaches to philosophy of education - Dearden's remarks about the absence of a distinctively Catholic perspective still apply. In the following essay, therefore, the authors have undertaken, via a critical analysis of Maritain's educational speculations of half a century ago, to try to discern some of the principal issues and considerations which would need to be addressed in the interests of identifying a distinctively Catholic educational philosophy. Epistemic decision theorists aim to justify Bayesian norms by arguing that these norms further the goal of epistemic accuracy—having beliefs that are as close as possible to the truth. The standard defense of Probabilism appeals to accuracy dominance: for every belief state that violates the probability calculus, there is some probabilistic belief state that is more accurate, come what may. The standard defense of Conditionalization, on the other hand, appeals to expected accuracy: before the evidence is in, one should expect (...) to do better by conditionalizing than by following any other rule. We present a new argument for Conditionalization that appeals to accuracy‐dominance, rather than expected accuracy. Our argument suggests that Conditionalization is a rule of coherence: plans that conflict with Conditionalization don't just prescribe bad responses to the evidence; they also give rise to inconsistent attitudes. Part of the Studies in Crime and Public Policy series, this book, written by one of the top philosophers of punishment, examines the main trends in penal theorizing over the past three decades. Duff asks what can justify criminal punishment, and then explores the legitimacy of actual practices by examining what would count as adequate justification for them. Duff argues that a "communicative conception of punishment," which he presents as a third way between consequentialist and retributive theories, offers the most (...) fruitful way of understanding punishment's meaning and justification. Duff addresses such questions as how much sentences should be constrained by proportionality requirements; what modalities of punishment best communicate their intended meaning; and what decisionmaking procedures he envisions. Gender discrimination and sexual harassment of female police officers by their male counterparts remain areas of liability where police departments appeared to have failed to effectively confront the nagging issues. However, the appreciable level of research conducted on these issues in the global North has not been matched by the South, where issues bordering on sexual violence have cultural underpinnings. Drawing from the case of the Nigeria Police Force, feminist analysis was used to explore the lived reality of 43 female (...) officers in a qualitative study. Participants expressed distress in abiding by structural discriminatory regulations against female officers which include non-admittance of married women into the force, forbidding unmarried officers from getting pregnant, and a stipulated minimum of three-year work period before a female officer can marry. Findings also indicated that participants suffer a variety of sexual harassment, intimidation, and, violence from their male colleagues, while they feel constrained in reporting their victimization. Important policy and practical implications requiring the Nigerian police to address hegemonic masculinity and promote gender equality were provided. (shrink)

Marcia Baron has offered an illuminating and fruitful discussion of extra-legal excuses. What is particularly useful, and particularly important, is her focus on our excusatory practices—on the ways and contexts in which we make, offer, accept, bestow and reject excuses: if we are to reach an adequate understanding of excuses, their implications and their grounds, we must attend to the roles that they can play in our human activities and relationships—and to the complexities and particularities of those roles. However, I (...) want to focus my comments less on the details of Baron’s discussions of excuses in extra-legal contexts than on the implications of her discussion for our understanding of excuses in the criminal law. What light (if any, a sceptic might add) can such analyses of our extra-legal concepts and practices throw on legal concepts and doctrines? (shrink)

The discovery of the microworld presented a serious trial for many systems of views held by mankind, including its logic. This world was found to lack the familiar solid bodies, the unchanging particles and interrelations between them, the reflection of which, in one way or another, is the logic of the macroscopic world. What elementary particle physics encountered in the microscopic world seemed illogical: the rest-mass of a particle equals zero; a part that is not smaller than the whole; a (...) particle that in diffraction experiments moved like a wave; and much else that was unusual and strange in the properties of elementary particles. In response to Lawrence Solum's advocacy of a ‘virtue–centred theory of judging’, I argue that there is indeed important work to be done in identifying and characterising those qualities of character that constitute judicial virtues – those qualities that a person needs if she is to judge well (though I criticise Solum's account of one of the five pairs of judicial vices and virtues that he identifies – avarice and temperance). However, Solum's more ambitious claims – that a judge's vice (...) necessarily corrupts her decisions, and that in at least some contexts we must define a legally correct decision as one that would be reached by a virtuous judge – should be rejected: we can undermine the former by attending to the requirements of due process, and the latter by attending to the ways in which a judge would try to justify her decision. In this article, we consider two independently appealing theories—the Growing-Block view and Humean Supervenience—and argue that at least one is false. The Growing-Block view is a theory about the nature of time. It says that past and present things exist, while future things do not, and the passage of time consists in new things coming into existence. Humean Supervenience is a theory about the nature of entities like laws, nomological possibility, counterfactuals, dispositions, causation, and chance. It says that none of (...) these entities are fundamental, since if they were, this would entail the existence of irreducible necessary connections between matters of fact. Instead, these entities supervene on a fundamental, non-nomological ‘Humean mosaic’ of property instances at spacetime points. We will further explain and motivate the Growing-Block view and Humean Supervenience in Sects. 2 and 3, but first, we turn to our master argument. (shrink)

After distinguishing different species of Legal Moralism I outline and defend a modest, positive Legal Moralism, according to which we have good reason to criminalize some type of conduct if it constitutes a public wrong. Some of the central elements of the argument will be: the need to remember that the criminal law is a political, not a moral practice, and therefore that in asking what kinds of conduct we have good reason to criminalize, we must begin not with the (...) entire realm of wrongdoing, but with conduct falling within the public realm of our civic life; the need to look at the different processes of criminalization, and to ask what kinds of consideration can properly figure in those processes; the need to attend to the relationship, and the essential differences, between criminal law and other modes of legal regulation. Niels Bohr was born on October 7, 1885. He was one of the great innovators in physical science in the twentieth century. It so happens that 1985 also marks fifty years since the long discussions, which had begun in the 1920s between Albert Einstein and Bohr on the philosophical problems of quantum physics, attained their apogee. An article co-authored by Einstein, B. Podolsky, and N. Rosen, "Can Quantum Mechanics Be Considered a Complete Description of Physical Reality?," was published in 1935 (...) in the journal Physical Review. According to Bohr, "by virtue of its clarity and, it would seem, flawless argumentation, the work of Einstein, Podolsky, and Rosen has created excitement among physicists and played a great role in the discussion of general philosophical questions of physics." Precisely as a result of the publication of this article, the critical position of Einstein concerning quantum mechanics became known to a broader circle of physicists. In the same year, Bohr responded to Einstein and his co-authors with an article under the same title. (shrink)

How can a system of criminal punishment be justified? In particular can it be justified if the moral demand that we respect each other as autonomous moral agents is taken seriously? Traditional attempts to justify punishment as a deterrent or as retribution fail, but Duff suggests that punishment can be understood as a communicative attempt to bring a wrong-doer to repent her crime. This account is supported by discussions of moral blame, of penance, of the nature of the law's demands, (...) and of the proper meaning and purpose of the criminal process of trial and verdict: it deals both with the ideals that should inform a system of criminal law and the extent to which those ideals are actualised in existing institutions and practices. The conclusion is pessimistic: punishment cannot be justified within our legal system; and this gap between the ideal and the actual presents us with serious moral dilemmas. (shrink)

I begin by discussing the ways in which a would-be blamer's own prior conduct towards the person he seeks to blame can undermine his standing to blame her. This provides the basis for an examination of a particular kind of 'bar to trial' in the criminal law – of ways in which a state or a polity's right to put a defendant on trial can be undermined by the prior misconduct of the state or its officials. The examination of this (...) often neglected legal phenomenon illuminates some central features of the criminal law and the criminal process, and some of the preconditions for the legitimacy of the criminal law in a liberal republic.
